Temple Legal Services is the trading name of Temple Litigation Ltd, which:
- is registered in England and Wales with the registration number 14138833
- is registered with the Office of the Information Commissioner and processes your data lawfully. We do not sell-on your data to third parties
- has a complaints procedure and policy which is available upon request and which forms part of any contractual relationship entered into
- has a conflict of interests policy to protect the interests of our clients
AUTHORISATION AND REGULATION
It is important that clients have absolute clarity about what is and what is not permissible for Temple Legal Services to do under the terms of the Legal Services Act 2007, and what services we offer to our clients. The below is intended to be a simple explanation of our services, and if you would appreciate further information, or an explanation of what any of the terms mean, please contact us for further details.
PROVISION OF UNRESERVED LEGAL SERVICES TO BUSINESES, ORGANISATIONS AND INDIVIDUALS
Temple Legal Services is not a firm of solicitors or a set of barristers and does not operate as either, or seek to hold-out as either. Solicitors are regulated by the Solicitors Regulation Authority (“the SRA”) and barristers are regulated by the Bar Standards Board (“the BSB”). Temple Legal Services and its parent company Temple Litigation Ltd are not regulated by either the SRA or the BSB. Temple Legal Services offers businesses, organisations and individuals legal consultancy and unreserved legal services on non-contentious issues where appropriately qualified and permitted to do so. Temple Legal Services are bound by the contractual, statutory and common law obligations to process client data lawfully, respect and maintain client confidentiality and to provide a competent service with reasonable care and skill. Temple Legal Services therefore prides itself on offering services to its clients which are professional and high-quality but at a much lower cost than solicitors and barristers offering the same service. CONFIDENTIALITY AND LEGAL PRIVILEGE
Temple Legal Services is bound by a contractual and common law duty of confidentiality to its clients, but this does not equate to its advice being legally privileged, which means there may be occasions where information we regard as confidential can fall to be disclosed by order of the court or under civil procedure rules. The advice we offer is therefore of a nature similar to that offered by other professionals (such as accountants) who are not authorised and regulated by either the SRA or the BSB.
INSURANCE
As Temple Legal Services are not authorised and regulated by any regulator, there is no requirement on the company to hold the kind of insurance that solicitors and barristers have. For details of our insurance coverage, please get in touch,
PROVISION OF LEGAL SERVICES TO LEGAL PROFESSIONALS
Temple Legal Services are legal consultants and offer outsourced litigation assistance to practising legal professionals. Temple Legal Services does not offer reserved legal activities which per the Legal Services Act 2007 are,
• the exercise of a right of audience
• the conduct of litigation
• reserved instrument activities
• probate activities
• notarial activities and
• the administration of oaths
Temple Legal Services does not exercise a right of audience except when applying an exemption available under Schedule 3 of the Legal Services Act 2007, i.e. when employed and appropriately supervised by a solicitor or a barrister authorised to conduct litigation by the Bar Standards Board.
OWNER AND OPERATOR
The Director and owner of the company, Mr Adrian Yalland, is personally regulated by the Bar Standards Board but does not practice as a barrister through Temple Litigation Ltd or Temple Legal Services. Mr Yalland remains personally subject to the Core Duties and Conduct Rules contained in the BSB Handbook. Although not practising as a barrister through Temple Litigation, he nonetheless employs the high ethical and professional standards which are expected of those regulated by the Bar Standards Board. This includes:
• Observing a duty to the court and the administration of justice
• Keeping his client's matters confidential and avoiding conflicts of interest
• Not discriminating against anyone unlawfully (i.e. on the ground of a protected characteristic as set-out in the Equality Act 2010
• Acting honestly, with integrity and behaving ethically and professionally in all client relationships
• Running business affairs competently, lawfully and in line with any regulatory requirements
